Part 4) Unarmed Victim Archive of Law Enforcement Murders 751-1,000

Turning Backs

Currently, there is no national database documenting the murders of un-armed people by police, security guards or self-appointed vigilantes. Although not all victims found here were weaponless, the fatal murdering of the unarmed: whether they are of ethnic origin, disabled, mentally ill, homeless or their sexual orientation, by Police Departments across the country is unjustified, and the vast majority of officers involved are not being held accountable.

I believe ALL those listed below regardless of whether they were in the process of perpetrating a crime, in a gang, drug possession, incarceration, resisting arrest, alluding, a weapon thrown aside, mentally ill or just happened to be at the wrong place at the wrong time, they are all victims. Victims who loved and were loved. This memorial is dedicated to all the Mothers and Fathers, Sons and Daughters, Husbands and Wife’s, Grandparents, Sisters and Brothers, Nieces and Nephews, Girlfriends, Boyfriends, Lovers, Friends and Neighbors who have lost someone at the hands of law enforcement. For all the heartbreak, shed tears, unanswered questions, lies and grief for a life unfulfilled, to you I give honor, for “there but for the grace of God go I”. May you find peace in knowing their bloodshed will not go unnoticed nor will their life be forgotten.

As we remember victims of violence let us remember the sadness of loss. May that sadness be transformed into compassion for the victim and their loved ones. May the fear struck in us by the power of tragedy give way to reverence at the unending power of unconditional love. May we uncover the energy of our anger and use it to right what is wrong in our own behavior toward one another and to challenge the mindsets and systems which enable and promote violence. May love gently wipe the tears from our eyes and remove the fear from our hearts. Look with favor upon the families and friends who mourn the victims and comfort those who are in grief and despair, that peace, the fruit of justice and charity may reign for each of us gathered here today. For all victims of crime, abuse, harassment and all who commit acts of violence; from those who speak harsh words in anger, to those who hate others who are different from themselves, to those who take the life of another, may we learn to act justly, love tenderly and walk humbly.

My definition of Unarmed
Please keep in mind I am only able to research and write bio’s on 5-7 victims per day. Each bio is verified through multiple sources, photos are retrieved, copied, cropped. Each bio is written and condensed close as possible to a single paragraph, many have links to READ MORE. Each name, age, state and ethnicity are entered into 3 data bases and then, after all pertinent information has been gathered I individually post to the website. Therefore each bio takes anywhere from 30 to 60 minutes to complete.

It is at my discretion as to what I consider as being unarmed. If the person has a weapon but is unable to use it because it’s under a seat, knocked to the side, fallen to the ground, in someone else’s possession etc. I consider that person unarmed. If someone is shot in the back, I consider that person unarmed. If there appears to be questionable circumstances surrounding the death, I consider that person unarmed. If the person is mentally ill and can be contained without using deadly force, I consider that person unarmed. Even if the person is a felon and has a violent criminal history, yet fits into any of the above categories, that person is still considered unarmed. If someone is in the commission of a crime, yet fits into any of the above categories, that person is still considered unarmed. If ANYONE can be contained without using deadly force, I consider that person unarmed.

There is no reason, in my opinion to shoot someone when police manage to apprehend and incarcerate extraordinarily dangerous serial killers/ mass murderers/spree killers and vigilantes yet cannot manage the capture of citizens of ethnic lineage without executing them.

However, if someone is shooting, holding a weapon or hurting someone (including an officer) and there is absolutely no other way to control them, I consider that person armed. Mind you, I credit witness statements far above police reports.

I DO NOT believe Law Enforcement reports. Lies the police tell that are so familiar anyone can recite them: “Reached for waist band”; “Pointed hand at police in a threatening manner.” “Backed the car toward officers” “Lunged at me” “Had a black object in hand” “Tried to grab gun” “Officers of the Un-Peace” or “Un-Peace Officers” Campaigns were formed against the “Blue Code” supposedly making it more visible to the public eye have taken place but all they seem to be doing is allowing the police to police the police and the police. Police are liars, period. So please don’t think I would even consider relying on their statements. The code of Blue Silence is too real to be ignored, and has been proven over and over again to be the real badge of the law.

As for Grand Juries they’ve been bought and paid for in more cases than can be counted. There is something fundamentally unfair about a grand jury system which doesn’t reflect the racial, political and ethnic diversity of the community it serves and the people it indicts.

Unfortunately due to the ongoing killings by Police and vigilantes claiming Stand Your Ground (Castle Doctrine) this list will continue to grow. Please keep in mind each victim is double and triple checked for accuracy, therefore it takes approximately 40-60 minutes to complete each bio, including editing, separating into 4 data bases and posting online to the appropriate page(s). This website is an extremely time consuming endeavor, yet a true labor of love, but often mentally overwhelming and occasionally must be set aside as I regroup. If you have a family member, friend or know of someone killed at the hands of Law Enforcement or Vigilante(s) please leave their name, age, state, date of death etc. by replying in the comment box; they will be given top priority on the next post and you will receive links to their location(s). Completed bio’s on this page have ** # and 1, 2, 3 or 4 behind the entry denoting the part/page where the bio can be found. Due to lack of space ((#)) signifies mental disorders, including but not limited to Suicide.

This Is What It’s Like To Be An Unarmed Black Man In America

Salladin BartonSalladin Barton 35, (Mentally ill Black Male) Broome County Jail Binghamton New York Jan. 15, 2015 – Barton, was awaiting trial. Jail employees harassed Barton, for being an African American, calling him racial slurs, beating him and denying him food. Barton suffered from a mental illness and had physical ailments which required medical treatment. Jail employees would place food near his cell, but out of reach, and then come by and throw it in the garbage. Other inmates, would share their food to keep him from starving. In addition to preventing Barton from eating corrections officers threatened Barton’s family and took off all his clothes – leaving him naked in his cell. The abuse agitated Barton’s mental illness, causing him to bang his head against cell bars and break out in seizures. Alvin RiosAlvin Rios Jr. 41, (Hispanic Male) Broome County Jail Binghamton New York July 20, 2011 – Rios was arrested on a drug warrant July 19, 2011, by Broome County Sheriffs deputies. Rios sought medical attention for drug withdrawal, specifically from opiates. And although nurses were alerted to his condition, a staff doctor at the jail at the time never was. A corrections officer found Rios just after 4 p.m. face-down and shaking in his jail cell the following afternoon. It was just minutes after Rios was last seen asking for a newspaper. But the response from a former staff nurse contributed to his death. “The RN clearly left his patient in an emergent life threatening status without appropriate medical attention”. The nurse in question has since been fired for failing to follow both state and company policy. No Photo Available-001William Slusar San Diego California April 25, 1991 – Slusar’s father called 911on Sept. 11 requesting paramedic assistance for his son, who was under the influence of amphetamines “real bad off on drugs. . . . He just got violent.” Before police arrived Slusar hit his 65-year-old father on the forehead with a stick. Police claim Slusar threatened them with a stick, was shot three times and killed by San Diego officer Charles M. Rice Jr., one of four cops at the scene and shot three rounds from a 9-millimeter automatic pistol, hitting Slusar twice in the upper chest. Slusar died at the scene. At the time, Rice had been a cop fewer than five years and had been involved in a previous on-duty shooting. He had been found to have used unnecessary force three other times. District Attorney Edwin Miller ruled the shooting justifiable but said his decision was not “an endorsement of the actions of the officer involved.” “It seems exceedingly unfortunate that four officers were unable to disarm a man wielding a stick. Ashley MacDonaldAshley MacDonald 18, (Female) Huntington Beach California Sept. 7, 2006 – MacDonald had left her apartment carrying a pocket or cutter-like knife “acting strangely” following a fight with her mother. Police officers claim they repeatedly asked her to drop the knife and allege instead of dropping the knife she continued advancing toward the officers in a threatening manner when Police Officers Read Parker and Shawn Randell shot her 15 times, eight to her back.. A third officer present did not fire his weapon. Orange County District Attorney Tony Rackauckas said the 120-pound woman threatened the cops with a knife with a four-inch blade. Errol ChangErrol Chang 34, (bi-polar and schizophrenic) San Jose California March 18, 2014 – His family called for help. “One of the officers Tased Errol, and he started to run towards the house passing an officer and I tackled him. The officers were pointing their guns and yelling at me to get off of him, and pulled me off.” rather than taking advantage of the opportunity to restrain Errol, the six police officers pulled Matt off him, allowing Errol to enter the house. . Once in the house, the situation escalated further. Learning that there was a rifle in the house, albeit taken apart and hidden in three locations, police called in the SWAT team. It is tempting to second-guess the wisdom of parking a tank full of armed SWAT members in full view of a man who just said “Obama was trying to assassinate” him, confirming his worst delusions. t the time Errol had his arms out the front window in the surrender position, seemingly contained, but the police didn’t want to risk Errol finding the rifle after darkness fell. Once the officers got into the home from the back, they discovered that Errol had constructed a barricade of “mattresses and furniture, which blocked the hallway from the front room where Mr. Chang was.” Errol’s father had told the officers that he had hidden the rifle in the bathroom, which was NOT behind the barricade. All they had to do at this point was search the bathroom for the rifle. If they had, they would have found that it was still there and that Errol was unarmed. Once Errol was known to be unarmed. But instead, the police chose to shoot flash-bang grenades into the living room—further agitating Errol—and tore down the barrier Errol had constructed, leaving themselves vulnerable to a frightened, psychotic, schizophrenic man with a knife. The outcome was inevitable. Errol tried to defend himself from this invading force, stabbing an officer in the arm, resulting in seven shots fired at him, killing him instantly. http://www.pacificariptide.com/pacifica_riptide/2014/06/opinion-da-report-on-errol-chang-shooting-tells-only-half-the-story.html

No Photo Available-001Denzel Brown 21, Long Island New York March 22, 2015 – Officers responded to a 911 call about a larceny occurring at Best Buy. When the first officer arrived, a witness indicated to the officer where the suspect, identified as Denzel Brown, was hiding outside the store. As the officer approached, the suspect fled through the parking lot and the officer chased him on foot. The officer deployed a Taser, but it was ineffective. As Brown was running away, he attempted to open the doors of both moving and parked vehicles in the parking lot. He then attempted to steal a running car from a couple while two children, ages 4 and 6, were sitting in the back seat. The couple was screaming at Brown to stop as the officer caught up with him and ordered him out of the vehicle. However, Brown began to drive away and the officer fired one shot at him, opened the car door and attempted to remove Brown from the vehicle. During the struggle, the officer deployed the Taser, which again was not effective. The officer fired another gunshot, at which time, assisting officers arrived and took Brown into custody. Christopher Ryan HealyChristopher Ryan Healy 36, (White Male) East Portland Oregon March 22, 2015 – Two officers were dispatched after a 911 dispatchers got a report from a neighbor who claimed a man was committing a burglary. The 911 caller told dispatchers Healy was holding down the suspect. When police arrived they contacted Healy and as the officers approached Healy allegedly advanced toward them with a double-bladed knife, 10 inches long, in a weaving, figure-8 motion.
One of the officers, Thomas Clark fired two rounds, striking him although Healy remained on his feet. The other officer, Royce Curtiss re-holstered his weapon and deployed a Taser. Witness Tera Harris says her daughter is a close friend of Healy and says “the man left the house after getting out of the shower and was walking towards a vehicle to go sit in and wait for her daughter”. She disputes the neighbor’s claim Healy was committing a burglary and she never heard officers order Healy to put his hands up, but added that she was inside. Harris says she and her family moved into the apartment about two months ago. The man who made the report about a burglary also moved in that time, Harris says “she and the neighbor have had problems ever since. Once Healy was taken into custody, police called for paramedics who took him to a local hospital where he was pronounced dead. Detectives learned the incident began as a neighborhood dispute over the weekend between the occupants of two residences. Both officers have been placed on standard paid-leave pending a review by the Multnomah County Grand Jury. No Photo Available-001Walter Brown III 29, Portsmouth Virginia March 24, 2015 – Police were conducting surveillance at Southside Gardens apartments when a vehicle with two people inside caught officers’ attention. Officers tried to interview the car’s occupants at The passenger got out of the vehicle, but the driver refused and drove away, allegedly almost hitting a detective. Police followed the car to where the car pulled onto a lawn and the driver ran up to the front door of his house. An officer used a stun gun on the man, but it had no effect. The man and the officer began struggling as they moved inside. They went through a living room, down a hallway and into a bedroom. Two backup officers arrived. One of them used a stun gun, again with no effect. Allegedly Brown pulled out a handgun. One of the officers spotted it and yelled, “gun,” then tried to grab it and the man’s hand. Another officer fired his service weapon three to five times. It did not appear that the man fired a gun. Medics pronounced the man dead. Brown’s wife, Octavia was inside the house and had been ordered out of the room where police and Brown continued to fight. Then she heard shooting. She said police would not let her see her husband inside their home. He had gone out to pick up lunch before work. Why would they take him from us?” she asked. “Why would they take him from his kids?” She said police treated her husband like an animal. “He didn’t drink, he didn’t smoke, he was a family person,” “He did not have a weapon.” Murdered by Portsmouth PD http://hamptonroads.com/2015/03/portsmouth-police-shoot-and-kill-man-after-chase

Wayne ScottWayne Scott Creech 74, (White Male) Spokane Valley Washington Aug. 25, 2010 – Pastor Creach, had gone to check on why a car was in his parking lot of the Creach family’s nursery and greenhouse complex so late at night. Officer Hirzel was in uniform but driving an unmarked patrol car and had pulled into the nursery lot to watch for prowlers in the neighborhood. Officer Hirzel was writing up a collision report about 11:07 p.m. when he saw the shirtless Creach approach with a gun in his right hand and a flashlight in his left. Though no witnesses heard him, Officer Hirzel said he ordered Creach five or six times to drop the gun. He said Creach replied that he didn’t have to and instead put the .45-caliber, semi-automatic pistol in his back waistband. Hirzel said he ordered Creach to the ground, but the older man refused, and the deputy struck Creach in the leg with his baton using a backhand swing. Officer Hirzel said Creach then reached for his gun and Hirzel fired when he saw the butt of the weapon. Officer Hirzel shot Scott once in the chest and died shortly after. Right after the shooting, Hirzel was allowed to take a scheduled vacation to Montana and Las Vegas – a fact which wasn’t revealed to the public for several days, and prompted a public outcry. Nine days passed before detectives interviewed Hirzel about the shooting, and by then the deputy couldn’t recall several details about the fatal encounter, such as how close he was to the pastor when he shot him; how it happened that his patrol car’s spotlight was turned on and pointed in Pastor Creach’s direction; and whether his request for backup was made before or after the baton strike. When the police arrived, they went to the pinned-down Burks, and cuffed his left hand. The officer was trying to cuff Burks’ other hand. Burks did not cooperate with commands to take his right hand from underneath his torso to allow officers to cuff him. Officers then sprayed mace in his face. Officers finally cuffed him, and struggled with Burks, who was staying limp, out to the squad car. Burks refused to get into the squad car, so the officer tasered him twice. Michael Angel RuizMichael Angel Ruiz 44, (Mentally ill Hispanic Male) Phoenix Arizona Aug. 2, 2013 – Police allegedly responded to a call about a man on a roof and found Ruiz on the roof of his house. He may have had mental health issues, according to family and friends. They forced him down with their tasers, in direct contravention of their own department’s policy for not using tasers on people in danger of falling; he then jumped or fell from the roof to his outside stairway. Police were waiting, and once surrounded they placed Ruiz in a chokehold for several minutes while tasering him again. Multiple officers then dragged Ruiz down a long flight of concrete steps, and in video of the incident his head can be seen striking each step as they dragged him down. Anthony Damone Clark ReedAnthony Damone Clark Reed (Black Male) 24, Detroit Michigan April 31, 2015 – Reed was pulled over by Detroit PD for illegally tinted windows on his Dodge Charger. He was placed in handcuffs and made to stand outside. Anthony suffered from asthma and his father tells us he believes his son would still be alive, if police had acted more quickly during his son’s asthma attack. Reed asked for an inhaler from his car, which they gave him, but he still couldn’t breathe. When he couldn’t breathe, police say they gave him CPR and called an ambulance, but he couldn’t be revived. His father questions that story and the immediacy with which officers acted. Pedro RiosPedro Rios Jr. 14, (Hispanic Male) Chicago Illinois July 4, 2014 – On July 4, 2014, as the final explosions of Chicago’s lakefront fireworks extravaganza trailed into the water and began fading in the night sky, 14-year-old Pedro Rios Jr. crossed Cicero Avenue in front of an approaching police car, on the northwest side of town. A brown-skinned boy just over 110 pounds, sporting a low fade haircut and the faint beginnings of a mustache, Rios walked in blue-and-white sneakers, shorts and a blue T-shirt – which soon bore the marks of two gunshots, fired into his back by a police officer. Rios was shot twice in the back and killed laying face down in an alley, where his body remained for two hours before being pronounced dead. The police account, however, offers a different scenario, in which Rios ran from officers, was shot and continued to run, pivoted, and ran back toward the officer who then tackled him. Official copy of the boy’s death record, certified by the Cook County medical examiner, states “suicide” under “manner of death.” http://www.truth-out.org/news/item/29989-non-fatal-how-a-boy-s-deadly-shooting-by-chicago-police-uncovers-accountability-mechanisms-designed-to-fail

Walter ScottWalter Scott 50, (Black Male) North Charleston South Carolina April 4, 2015 – Pulled over for a broken taillight Scott had a warrant out for his arrest, video shows. The three-minute clip starts out shaky, but it levels off as Slager and Scott appear to be grabbing at each other’s hands. as several objects fall to the ground. Scott starts running away. Wires, presumably from Slager’s Taser, stretch from Scott to the officer’s hands. With Scott more than 10 feet from Slager, the officer draws his pistol and fires seven times in rapid succession. After a brief pause, the officer fires one last time. Scott’s back bows, and he falls face first to the ground near a tree. After the gunfire, Slager glances at the person taking the video, then talks into his radio. The cameraman curses, and Slager yells at Scott “Put your hands behind your back” as sirens wail before he handcuffs Scott as another lawman runs to the scene. Officer Slager walks back to his taser, picks it up the walks back to Scott and drops it close by. Officer Slager reported Scott grabbed for the taser and felt threatened, but the damning video, filmed by witness Feidin Santana, told a much different story. Wires from a deployed stun gun can be seen streaming from Scott’s back as he makes a run for it. The video shows Slager take aim and fire off eight shots, the last one causing Scott to crumple and fall to the ground 30 feet away. The evidence of excessive force was so strong that Slager’s former attorney, David Aylor, dropped the killer cop as a client immediately after watching the clip. And Santana, who admitted he’s “scared” of being the lone eyewitness, says Scott “was trying to get away from the police officer.” GRAPHIC VIDEO http://www.nytimes.com/2015/04/08/us/south-carolina-officer-is-charged-with-murder-in-black-mans-death.html?_r=1

The penalty for robbing people and assaulting them with pepper spray is not death, though it inspires more sympathy for his victims than the perpetrator. That said, the behavior of Officer Terry Liles who shot Cooke some 16 times while he lay under a sleeping bag is worrisome. Liles had already raised hackles for his shooting of 16 year-old Christopher Burgess in October 2006 and Eureka resident Cheri Lyn Moore in April 2006. Burgess is alleged to have then pulled a hunting knife — 10 inches from handle to tip — on the officers. They Maced him but he still managed to back them out of the house at knife point before taking off on foot through neighbors’ yards and down into the gully. Probation officers called for back-up, saying they were in pursuit of a male subject with a knife — they didn’t mention his age or name. An off-duty sheriff’s deputy, who was picking up his/her child from school saw the commotion and joined the chase. Officer Liles arrived, located Burgess, yelled to him to give up and made his way into the steep ravine. Minutes later, Christopher Burgess was dying. The first bullet had gone through his heart and lodged in his spine. The second entered his hip and came to rest in his abdomen. Liles and other officers carried Burgess to the street. An ambulance brought him to the hospital, just blocks away. He was pronounced dead. Ashley FallisAshley Fallis 28, (White Female) Evans Colorado Jan. 1, 2012 – Former officer Tom and Ashley Fallis had hosted New Year’s Eve party at their house which 15-20 people. Tom Fallis had consumed a large amount of alcohol and became enraged when someone brought marijuana to the party Ashley told her husband she was going outside to “have a smoke” He became irate at the belief that she was going to smoke marijuana and threw everyone out of the house. According to witness testimony, neighbors overheard Fallis yelling at his wife, and her pleading with him to get off of her. This led to an argument between Tom Fallis and another woman which ultimately led to him storming into the master bedroom and slamming the door behind him. The argument between Tom and Ashley Fallis continued in their bedroom and during which Tom Fallis grabbed a handgun, held it to Ashley Fallis’ head and pulled the trigger. One neighbor said that he overheard the former officer confess to the killing, and one of the couple’s young children even gave eyewitness testimony to police, and stated her father had killed her mother. The 6-year-old little girl heartbreakingly told detectives that she saw “daddy getting the gun ready” and “saw daddy shoot mommy.” Despite all of this, plus the gunshot being in the back of her head, the detectives ruled it a suicide and allowed Officer Fallis to remain free. The family of his wife had witnessed the fight and knew the man’s history of violence and had pushed for years to have the case reopened ever since. Eventually, the case was reopened, and Fallis was arrested for second degree murder. A deputy admitted that he had overheard Fallis confess to killing his wife on the night of her death as he responded to the scene, and he never reported it to anyone. It was also reported that none of the four deputies who immediately responded to the shooting filed reports on their involvement. Clifford GloverClifford Glover 10, Black Male Jamaica New York April 28,1973 – Mr. Armstead woke 10 year old Clifford before dawn so they could be at the yard to move cranes into place for a delivery. They walked a few blocks when an unmarked car pulled alongside them. Mr. Armstead, carrying wages he had been paid the day before, said he and Clifford ran, afraid that they were going to be robbed. Hearing shots, he flagged down a patrol car, not realizing Clifford had been felled. Officer Shea testified he did not realize Clifford, who stood just five feet tall and weighed less than 100 pounds, was a child. After the shooting, prosecutors said, Officer Shea’s partner, Walter Scott, was recorded on a radio transmission saying, “Die, you little _____”. The officer claimed he fired when Clifford, in flight, pointed a gun at him, which the mortally injured boy had then managed to toss or hand to his stepfather. Chief Homicide Prosecutor Mr. Gaudelli said “Guys were trying to help Shea, and coming up with all kinds of stuff”. “Someone showed up with a starter’s pistol, but as soon as you pressed them on it, they folded. There was no gun.” Officer Shea became the first police officer in nearly 50 years to be charged with committing murder while on duty. “Shea says that the kid turned and appeared to have a gun,” Mr. Gaudelli said. “That’s what got him indicted: The ballistics made Shea a liar.” But not, apparently, a murderer, at least in the eyes of the jury of 11 white men and one black woman who found him not guilty. Afterward, many of the jurors joined Officer Shea and his lawyers at a restaurant to celebrate. They told reporters it was possible Mr. Shea had been telling the truth about seeing a gun. “The bullet entered his lower back and came out at the top of his chest. He was shot T-square in the back, with his body leaning forward. He was running away.” http://www.nytimes.com/2015/04/17/nyregion/fired-at-queens-boy-fatal-1973-police-shot-still-reverberates.html?_r=1

Natasha McKennaNatasha McKenna 37 (Mentally ill Black Female) Fairfax Virginia Feb. 3, 2015 – Ms. McKenna was restrained with handcuffs behind her back, leg shackles and a mask when a sheriff’s deputy shocked her four times. McKenna initially cooperated with deputies, placed her hands through her cell door food slot and agreed to be handcuffed. But McKenna, whose deteriorating mental state had caused Fairfax to seek help for her, then began trying to fight her way out of the cuffs, repeatedly screaming, “You promised you wouldn’t hurt me! Six members of the Sheriff’s Emergency Response Team, dressed in white full-body biohazard suits and gas masks, arrived and placed a wildly struggling 130-pound McKenna into full restraints. When McKenna wouldn’t bend her knees in order to be placed into a wheeled restraint chair, a lieutenant delivered four 50,000-volt shocks from the Taser, enabling the other deputies to strap her into the chair. Within minutes of being shocked by the Taser, McKenna stopped breathing. The reports show that jail deputies were unable to revive her using CPR and that her heart was stopped for about 20 minutes before paramedics revived her in the ambulance en route to Inova Fairfax Hospital. Then her heart stopped three more times over the next hour before she was stabilized. The reports show that deputies quickly placed a defibrillator on McKenna, but three times the machine advised “Do Not Shock,” which it will do when a heart has completely stopped, experts said, because an electric shock will not restart the heart. David “Bones” HebertDavid “Bones” Hebert 40, White Male Cincinnati Ohio April 18, 2011 – Hebert allegedly stole a sword from a friend and stabbed him with it. Police were called and, less than 15 minutes later, found Hebert, a woman and a leashed dog several blocks away. Herbert was allegedly intoxicated and had trouble standing. Police asked a seated Hebert where the knife was. He denied having one, then stood up and reached into his right front pants pockets. Police claim Herbert swiped a switchblade at officers and that’s why Officer Mitchell shot him. Police told him several times not to reach in his pockets, but Hebert pulled out what Deters called a butterfly knife with a six-inch blade “and stepped toward the officer.” One officer stepped back. Another, Mitchell, fired twice, hitting Hebert in the left arm and chest. As he was falling to the pavement, Hebert supposedly threw the knife, hitting and breaking the window of a nearby house. The four officers’ accounts are conflicting and highly subjective but on close examination contradict rather than support the official account. Wilfredo JustinianoWilfredo Justiniano 41 (schizophrenic Hispanic Male) Boston Massachusetts June 2013 – Harrison’s mother called 911 to ask police for help in bringing him to a hospital for treatment. Police found him “who seemed to be distraught” by the side of the road. When a state trooper arrived at the scene on busy Route 28 in Quincy, he found exactly that: Wilfredo Justiniano shouting at the officer to go ahead and kill him. What happened next, according to a lawsuit police violated Justiniano’s civil rights and caused his wrongful death by excessive force. When chemical spray did not stop the agitated, unarmed man from advancing toward him, the state trooper shot and killed him. Colonel Timothy P. Alben, head of Massachusetts State Police, and Trooper Stephen Walker gave a statement after the shooting saying he tried to calm Justiniano down, assuring him he would not kill him. When Walker noticed a pen in Justiniano’s hand, he told him to drop it. Instead, the man moved toward him, saying, “You want it, you’re going to have to kill me.” Walker said Justiniano also threatened his life. According to his statement, he administered chemical spray twice; when Justiniano kept coming at him, he shot him twice, including once in the chest. https://www.bostonglobe.com/metro/2015/04/13/family-sues-state-police-shooting-unarmed-man-with-mental-illness/0wznbkIQo6DPxp2DCNAeHJ/story.html#

Milton Milton HallBrandon Milton Hall 49 (mentally ill Black Male) Saginaw Michigan July 1, 2012 – Video shows six police officers, in firing squad fashion, execute mentally ill, Milton Hall, in broad daylight in a Saginaw parking lot. Hall was several meters away from the closest police officer when the shots began. He posed very little threat to the officers as he was armed with a small pocket knife and could have easily been brought down with a taser. Six Saginaw police officers fired 46 times at the 49-year-old Hall, striking him 14 times. Police claim Hall acted aggressively, according to then-Saginaw County Prosecutor Michael D. Thomas. After a thorough investigation, federal authorities have determined this tragic event does not present sufficient evidence of willful misconduct to lead to a federal criminal prosecution of the police officers involved. Ervin Leon EdwardsErvin Leon Edwards 38 Black Male Inmate Baton Rouge Louisiana Nov. 26, 2013 – Police were questioning Edwards about an argument with his girlfriend and then began harassing him over his “sagging pants”. At the gas station where Edwards was arrested, Edwards girlfriend told the officer Edwards had a medical condition, and to please not tase him. Dragged into an isolation cell and surrounded by about half a dozen law enforcement officers, Edwards sometimes struggled with them. At other times, he appears to be lying still. At one point, while Edwards apparently resisted attempts by officers to restrain him, a Port Allen police officer shocked Edwards with a stun gun. Not long afterward, the inmate quit moving. The officers then slowly backed away from him and exited the cell. Except for a few peeks through a window of the cell’s door, about 10 minutes go by on the video before deputies and officers returned to the cell to check on him. Edwards, lying still on his stomach, doesn’t appear to move at all during that time frame. For corrections and use of force experts who reviewed the video footage, that 10-minute gap without checking on Edwards looks like a critical error. The video shows Officer McMullan keeping the stun gun pressed firmly against Edwards for nearly a minute and a half. Thaddeus McCarrollThaddeus McCarroll 23 mentally ill Black Male Jennings Missouri April 18, 2015 – Jennings PD responded to a residence regarding an armed subject. Officers contacted the owner of the residence outside, who stated she wanted her son Thaddeus to be removed from her residence due to his abnormal behavior. She told officers on scene her son had locked her out of the house and was armed with a knife and was talking about going on a “journey” and a “mission” and mentioned a “black revolution.” Officers could see the subject through the front window of the residence, walking around the inside of the house with several knives and a Samurai sword. Several unsuccessful attempts were made to speak with McCarroll and have him come out of the residence. At 10:30 p.m., a supervisor on scene declared the situation to be an armed, barricaded subject, and requested assistance from the Tactical Operations Unit. The Tactical Operations Unit responded, took control of the scene, and began negotiations. After approximately one hour of negotiations, the man exited the residence armed with a knife in one hand, and a bible in the other. Tactical Officers on scene began giving loud, verbal commands to McCarroll, ordering him to drop the weapon. A tactical negotiator tried to establish a dialogue, continuing to ask him to put the knife down and come speak with them so they could resolve the situation in a peaceful manner. McCarroll started walking towards officers still armed with the knife. As he got closer, one of the tactical officers fired a less-lethal round at the man in an attempt to disarm him, but it had no effect. On the day of the alleged attack, deputies “for no justified reason or lawful justification, physically assaulted and struck Johnson in the head multiple times to the point where he was unconscious … then in an effort to cover up the unprovoked and malicious attack, hung Johnson in his cell with a bed sheet. Of course the sheriff’s spokesman declined comment, saying he had not seen the complaint. Gustavus RugleyGustavus Rugley 21 B/M San Francisco CA June 29, 2004 – Gus had been under surveillance that day from 8 a.m. to 6:30 p.m. He left the house twice on foot. The third time he left the house, his truck was not sitting in the front of the house. Rugley was watched by over 20 officers — there was the gang task force, homicide, special units and tactical units. Police were on a mission that day, and Gus was just a suspect. He was never once questioned, apprehended, asked to come to the station. He left twice that day, not one person ever tried to stop him. When Mr. Rugley was walking on the streets, before he got to his truck, not one officer tried to apprehend him and say, “You’re under arrest.” They baited him to get him into his truck. They were in unmarked cars — all the officers were in plain clothes. No lights, no sirens. Witness, Anna Catreras, said Mr. Rugley sat in his truck and an officer in a light blue sweatshirt walked up, opened up the back passenger door of Gus’ vehicle and proceeded to unload her gun. Officer shot Gus at point blank range, six in his head. Thirty-six bullets were retrieved from his body. Michael EllerbeMichael Ellerbe 12 B/M Uniontown PA Dec. 24, 2003 – Ellerbe was in a car which had been stolen during the night. The owner of the stolen car spotted it in the early afternoon and notified police. Police chased the car for about a mile before it crashed into a fence and tree. Troopers Juan Curry and Samuel Nassan claimed that they shot Michael after one of the officer’s guns accidentally went off and the other officer thought that the boy had shot at them. Nurses ignored his pleas for help concerning severe abdominal pain. During those ten days, Charles lost 23 pounds and often lay in his own vomit and diarrhea. Several times guards brought him to the medical unit, once on a stretcher because he was too weak to walk. On the evening before his death, inmates who shared Charles dorm complained that he had open sores and was vomiting and having bowel movements. Charles was moved to a private cell where he screamed, I’m dying, I’m dying. I can’t breathe. Guards called a nurse who sat outside Charles cell for five minutes. He had quit screaming so she never entered the cell. Five hours later, a guard found Charles body. Rigor mortis had already set in. Charges of manslaughter and preparing false evidence have been brought against a prison nurse and former nursing director. He was a person crying for his life and no one caring, said one of Charles dorm-mates. A settlement has been reached in a lawsuit linked to the 1997 death of Tulsa Jail inmate Charles Edward Guffey. Then they beat him with a metal baton from head to foot, tasered him, tortured him, slit his throat, and stomped on him with boots. Kenneth suffered a smashed skull, boot marks on his face, tearing, and large cut marks on his throat. They cleaned up the blood and placed the body in a different cell which was clean of any blood. Then they claimed Kenneth had died of suicide. However, they refused to allow any medical staff or investigators to enter the jail. They tried to coerce Kenneth’s family to sign a permission form to allow the guards to cremate the body, which would destroy the body as evidence. The family refused. When the family received the body from the prison authorities, it was covered in wounds, cuts, and bruises, leading the family to believe Trentadue had been tortured and beaten before his death. Trentadue had sustained three heavy blows to the head, and his throat had been cut; prison authorities claimed the wounds were self-inflicted. When the body was finally examined, the guards could not explain how Kenneth could have received such injuries without the use of a taser, knife, boots, or the metal baton which crushed his skull. Nor could they explain how Kenneth could have torn a gash in his own throat with his bare hands after slicing his own throat. They could not explain the absence of blood in the cell where they claimed that the suicide took place. The clean-up job at the true murder scene was sloppy and small blood stains were found. The guards could not explain that either. No arrest was made, no charges filed, no punishment of any kind given. Attorney General Janet Reno has stonewalled attempts to investigate Kenneth’s murder. http://www.apfn.org/apfn/OKC_Trentadue.htm

No Photo Available-001Ray Peters July 6, 1980 Oklahoma City OK- Mr. Peters and two other men were shot and killed while playing pool at a motel. Clifford Henry Bowen, a professional poker player with a history of burglary, was charged with the three murders and sentenced to death. Two years later, a lawyer for Mr. Bowen received information indicating that a South Carolina police lieutenant had committed the murders. The lieutenant’s physical description matched the killers. He was known to carry a .45 caliber automatic loaded with unusual silver tipped bullets (the weapon used in the murder), and Ray Peters ex-wife, who was now married to the lieutenant, had reportedly been slapped and threatened by her ex-husband. The lieutenant had been in Oklahoma on the day of the shooting and returned to South Carolina later that day. Prosecutors knew all this at the time of Mr. Bowen trial but concealed it. In response to Mr. Bowens well-supported alibi that he was at a rodeo 300 miles away a few hours before the murder, the prosecutor contended, with no evidence, that he had taken a private jet to get to Oklahoma City. Mr. Bowens conviction was thrown out by a federal appeals court after he had spent five years on death row. http://policecrimes.org/forum/viewtopic.php?f=12&t=189

Then he spent more than one thousand days on Rikers waiting for a trial that never happened. During that time, he endured about two years in solitary confinement, where he attempted to end his life several times. Once, in February, 2012, he ripped his bedsheet into strips, tied them together to create a noose, and tried to hang himself from the light fixture in his cell. They spoke about his paranoia, about how he often suspected that the cops or some other authority figures were after him. His mother explained, the night before he told her, “Ma, I can’t take it anymore” Browder went into another bedroom, pulled out the air conditioner, and pushed himself out through the hole in the wall, feet first, with a cord wrapped around his neck. His mother was the only other person home at the time. After she heard a loud thumping noise upstairs, she went upstairs to investigate, but couldn’t figure out what had happened. It wasn’t until she went outside to the backyard and looked up that she realized that her youngest child had hanged himself.
